Ride Blue B.V. - Terms and Conditions

1. Acceptance of Terms and Conditions:

By accessing or using the Ride Blue B.V. electric scooter ride-sharing service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Eligibility:

To use Ride Blue B.V.'s electric scooter ride-sharing service, you must be at least 18 years old and possess a valid driver's license. By using our services, you confirm that you meet these eligibility criteria.

3. Rental Process:

a. To rent an electric scooter, users must download the Ride Blue B.V. mobile application, register an account, and provide accurate and up-to-date information. b. Users are responsible for keeping their account credentials confidential.

4. Scooter Usage:

a. Users are required to follow all traffic laws and regulations while operating Ride Blue B.V. electric scooters. b. Electric scooters are to be used only for personal transportation and should not be used for any commercial purposes.

5. Safety Measures:

a. Users must wear appropriate safety gear, including helmets, while operating Ride Blue B.V. electric scooters. b. Riders are responsible for inspecting the scooter for any damage before starting a ride and reporting any issues through the mobile application.

6. Fees and Payments:

a. Users agree to pay all applicable fees associated with the use of Ride Blue B.V. electric scooters. b. Ride Blue B.V. reserves the right to charge users for lost or stolen scooters or damages occurring from user misconduct, as determined by the company.

7. Prohibited Activities:

a. Users are prohibited from engaging in any illegal activities while using Ride Blue B.V. electric scooters. b. Vandalism, tampering, or misuse of the scooters is strictly prohibited.

8. Liability and Indemnification:

a. Ride Blue B.V. is not liable for any injuries, damages, or losses incurred while using our electric scooters. b. Users agree to indemnify and hold Ride Blue B.V. harmless from any claims, losses, or damages arising from their use of the service.

9. Unforeseeable Events:

Neither Ride Blue B.V. nor the user shall be responsible for damages or for delays or failures in performance resulting from acts or occurrences beyond such party’s reasonable control, including, without limitation: (i) fire, lightning, explosion, power surge or failure, water, acts of God, war, revolution, civil commotion or acts of civil or military authorities or public enemies; (ii) any law, order, regulation, ordinance, or requirement of any government or legal body or any representative of any such government or legal body; (iii) labor unrest, including without limitation, strikes, slowdowns, picketing, or boycotts; (iv) inability to secure raw materials, transportation facilities, fuel; (v) energy shortages, or (vi) acts or omissions of other common carriers.

10. Privacy:

Data collection and use, including data collection and use of personally identifiable information, is governed by Ride Blue B.V.'s Privacy Policy available at https://www.ridebluesxm.com/privacy-policy which is incorporated herein by reference and is made part of this Agreement.

12. Termination of Service:

Ride Blue B.V. reserves the right to terminate or suspend service to any user for violation of these Terms and Conditions or for any other reason deemed necessary by the company.

13. Governing Law:

These Terms and Conditions are governed by the laws of Dutch Side, Sint Maarten and any disputes arising shall be resolved through arbitration in accordance with the rules of the local government.

14. Changes to Terms and Conditions:

Ride Blue B.V. reserves the right to update or modify these Terms and Conditions at any time. Users will be notified of any changes, and continued use of the service implies acceptance of the updated terms.
